It means Simpson, 31, will be risk-assessed by a parole team rather than automatically let out

She and the dad of Tony, now ten, got ten years in 2018.

She was let out on licence, but went back for breaching the conditions by having a fling with a sex offender.

She is due up for parole on May 19, with her hearing being held in private, although under a new policy Tony’s adoptive family are allowed to attend.

Tony’s adoptive mum, Paula Hudgell, 57, from West Malling, Kent, said: “We are relieved that Jody will be facing a full parole hearing rather than being released with no risk assessment.

“She was recalled to prison for good reason, and it’s only right considering what she did that checks and balances are put in place to stop her reoffending.

“As soon as she got out of prison last time, she started a relationship with a sex offender, she clearly can’t be trusted and needs proper oversight from a parole team if she is released in May.

“We are grateful that ministers have recognised this risk, and have acted on it.

“The only thing that would reassure us more is if she was added to a child cruelty register - similar to a sex offenders register - something we have been campaigning for for years.”

Tony's birth parents Anthony Smith and Jody Simpson abused him so badly as a baby that he was left with multiple fractures to his limbs at just six-weeks-old.

The evil pair then waited 10 days before seeking medical help, by which time Tony had also developed multiple organ failure and septicaemia.

Medical staff at Evelina London Children's Hospital saved the tot's life, but he had to have both legs amputated at the knee as a result of his injuries when he was four-years-old.

The mum and her evil partner Anthony Smith were both found guilty of causing or allowing serious physical harm to a child and cruelty and neglect to a person under 16 years in 2018.

Both were sentenced to 10 years in prison - the maximum penalty possible for this crime at the time of their conviction.

A Ministry of Justice spokesperson said: "This was a horrific crime that saw Tony Hudgell mercilessly tortured by his birth parents.

"Public safety is our top priority which is why it is right that the Parole Board conducts a full risk assessment to determine if Jody Simpson should be re-released."
